These Terms of Service ("Terms") are a legal agreement between you and Kapybara LLC, a Wyoming, United States limited liability company ("Maintainly", "we", "us"), and govern your use of the Maintainly app and website. By downloading, accessing, or using Maintainly, you agree to these Terms. If you do not agree, do not use the app.
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use Maintainly on devices you own or control, for your own personal, non-commercial home-maintenance purposes. You may not copy, sell, sublicense, rent, or reverse-engineer the app except to the extent the law permits.
You are responsible for activity under your account and for keeping your sign-in secure. You must provide accurate information and be old enough to form a binding contract in your country.
Maintainly is a reminder and organization tool only. Any suggested tasks, intervals, or guidance are general information, not professional, inspection, or safety advice. Maintainly is not a substitute for inspection, testing, or servicing by a qualified professional, and you remain solely responsible for your property, equipment, vehicles, and safety devices (such as smoke and carbon-monoxide detectors). Always follow manufacturer instructions and applicable laws, and consult a qualified professional when appropriate.
Do not misuse the app. You may not use it for any unlawful purpose, attempt to break, overload, or reverse-engineer the service, or infringe the rights of others.
You keep ownership of the content you add. You grant us only the limited permission needed to store, sync, and display it back to you so the app can function.
The app is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that reminders will always be delivered (for example, if notifications are disabled, your device is off, or a network is unavailable).
To the fullest extent permitted by law, Kapybara LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any property damage, loss, injury, or expense arising from missed, delayed, or incorrectly performed maintenance, or from your use of or inability to use the app. To the fullest extent permitted by law, our total liability for any claim relating to the app will not exceed the greater of the amount you paid us for the app in the twelve months before the claim or twenty US dollars (US$20).
We may change, suspend, or discontinue any part of the app at any time, and we may update these Terms. When we update these Terms, we will revise the effective date above. Your continued use of the app after changes take effect means you accept the updated Terms.
You may stop using the app and delete your account at any time. We may suspend or end your access if you violate these Terms.
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Wyoming will have jurisdiction over any dispute that is not subject to another binding agreement, except where applicable law gives you the right to bring a claim in your local jurisdiction.
